KARACHI: M/s Hussain Formaids has approached the Sindh High Court (SHC) and filed a constitutional petition against enhancement of valuing imported consignments of various secondary quality steel products.
On 26 March 2021, counsel for the petitioner stated that petitioner is regular importer of various secondary quality steel products and for same purposes, is also registered with the tax authorities, during course of its normal business, the petitioner has entered into import contracts/ L.Cs for import of secondary quality steel products’ at the price/ rates mentioned in the respective letter of credit, whereas, on arrival of respective goods, the petitioner is required to file goods declaration with customs authorities.
Counsel argued that however, petitioner is seriously aggrieved by the act of respondents for wrongful enhancement of transaction values of its imported consignment and, having no other efficacious remedy provided in peculiar circumstances, humbly invoke constitutional jurisdiction of this court.
Citing chairman FBR, collector of Customs Appraisement East and the deputy collector Group-V Appraisement East as respondents, petitioner pleaded the court may allow the caption petition in the same term as this court has decided the identical matters under various constitutional petitions with directions to the respondents to assess the petitioner’s consignments on declared transaction values in terms of section 25(i) of the customs act, 1969.
He further pleaded the court may declare that the denial to assess the import consignments of the petitioner under section 25(i) of the customs act, 1969 in absence of any valuation ruling under section 25A ibid, is again unlawful, illegal and without lawful authority.
