KARACHI: M/s Kohinoor Textile has approached the Sindh High Court (SHC) and filed a constitutional petition against detention of its imported consignment of clutch disc, clutch kit and clutch pressure plate from Japan seized by the customs authorities due to disputed valuation.
On 15 September 2021, counsel for the petitioner states that in the normal course of business, the petitioner is being active importer, wholesaler and engaged in lawful import and distribution/ sale of assorted goods for past many years, in the normal course of business, the importer, imported consignment clutch disc, clutch kit and clutch pressure plate from Japan through various complete duly supporting by the import customs genuine documents received by the importer through bank and filed goods declaration according with law.
He added that petitioner was shocked when its staff was informed that the importer deliberate mis-declaration in respect of concealing the engine cylinder capacity of vehicles by irrelevant catalogue in order to take an attempt of getting the goods assessed on lower value, therefore the customs authorities not consider the declared value and rejected/ refused to clear the imported goods on declared value and assessed the imported goods as per actual engine cylinder capacity of vehicle against the total value of imported goods for Rs1,42,92,038 therefore, increased the duty and taxes for Rs42, 93,744.
Citing Chairman FBR and The Collector of Customs MCC Appraisement West as respondents, petitioner pleaded the court may direct them to provisional release under section 81 of the customs act, 1969 read with rule 439 of the customs rules, 2001 imported goods of the petitioner, in the meanwhile the petitioner is ready to submit solvent surety/ pay order/ bank guarantee/ PDC against the different amounts of duty and taxes, before the nazir of this court.
