KARACHI: M/s Saqib Leather Store has approached the Sindh High Court (SHC) and filed a petition seeking release of its consignment comprising PU artificial leather/woven/non-woven detained by customs officials due to disputed valuation ruling.
On 25 July 2020, counsel for the petitioner submitted in his constitutional petition that petitioner’s company is engaged in the import of the PU artificial leather/woven/non-woven the brand of M/s Saqib Leather Store and during routine, petitioner imported above mentioned goods according with law and filed goods declaration and requested concerned customs officials to released his consignment as per declared valuation.
He further submits that however, concerned customs officials do not agreed with declared valuation and assessing the value higher than declared value, due to which petitioner is seriously aggrieved by the actions of the respondents, who held the consignment of the petitioner.
He stated that petitioner is ready to secure the differential amount of duty and taxes etc in shape of pay order or bank guarantee in accordance with law, he said that in several cases of similar nature pending in SHC, interim orders, directing customs officials to consider the petitioner’s requests for provisional release of their consignments, have been passed.
Citing secretary revenue division, chairman Federal Board of Revenue, collector of Customs Collectorate Appraisement West/East and Port Muhammad Bin Qasim and director valuation as respondents, petitioner pleaded the court to declare that act of the respondents is illegal, mala fide and arbitrary.
He further pleaded the court to direct the respondents to release his consignment of provisional release immediately accordance with law.
