KARACHI: A two-member bench of the Sindh High Court (SHC) granted urgent application and issued notices to the customs officials and deputy attorney general of Pakistan on a constitutional petition filed by Tradesol International and others seeking release order for their imported consignments of Ginger & Garlic etc.
On 11 November 2021, Kashif Nazeer advocate appeared on behalf of petitioners namely M/s Tradesol International, M/s S.Y International, M/s Kasim Sons, M/s AAG Impex, M/s Godil Cold Chain Pvt Ltd, M/s Sajid & Yousaf Impex, M/s A.K & Sons, M/s Bhatti Brothers, M/s R. K International, M/s Ahmed Enterprises, M/s Crown International Trading, M/s Souvenir Trading Co, M/s Afzal International, M/s M. A Sons, M/s Inayat Enterprises and others.
Counsel argued that petitioners are lawful importers of Ginger & Garlic according to law and never have been involved in any crime or tax evasion scam.
He added that during the course of their businesses, above-mentioned importers have imported the same and filed goods declarations according to law and requested customs officials for release the same, however, customs officials detained their consignments and demanded higher valuation despite filing valuation.
Counsel added the matter on urgent basis, therefore, court may grant his urgency and directed customs officials to release petitioners’ imported consignments according to law.
Citing Chairman Federal Board of Revenue, Collector of Customs Appraisement & Facilitation West and Director General for Valuation as respondents, petitioners pleaded the court may declare that act of the respondents is illegal, mala fide and arbitrary.
Importers also pleaded the court to direct them to release their imported consignments immediately and restrain them from taking any adverse action against the petitioners till final order in this constitutional petition.
