KARACHI: Sindh High Court (SHC) sought comments from tax authorities on petition challenged valuation ruling no 863/16 enhanced valuing of “Toilet soaps of various brands”
The SHC has directed the tax authorities to file para wise comments on a constitution petition filed by A.R Associates challenging the impugned valuation ruling no 863/2016 which enhanced the valuing of “Toilet soaps of various brands”.
A two-member bench, comprising Justice Munib Akhtar and Justice Saeeduddin Nasir was hearing the constitution petition.
During the hearing, Kashif Hanif filed power from tax department and sought time for submit para wise comments, therefore, court granted time and adjourned the hearing for October 31, 2016.
Earlier, counsel for the petitioner stated that petitioner is serious aggrieved and prejudiced by the unlawful act of the respondents, whereby the director directorate of general of customs valuation had issued valuation ruling no 863/ 2016 which the value of toilet soaps of various brands including the brand of the petitioner being “charm” had been enhanced and fixed/purportedly determined without adherence to the provisions of section 25 and 25 A of the custom act, 1969.
Citing Chairman Federal Board of Revenue (FBR), Director General Directorate of General of Custom Valuation, Director Directorate General of Customs Valuation, The Collector of Customs Model Custom Collectorate East, The Collector of Customs Model Custom Collectorate West and The Collector of Customs Model Custom Collectorate Port Muhammad Bin Qasim as respondents, petitioner pleaded the court may set aside/ vacate the impugned valuation ruling no 863/2016.
Importer also pleaded the Sindh High Court (SHC) may declare that impugned Valuation ruling is illegal, unlawful, mala fide and of no legal effect and restrain the respondents from taking any coercive action against the petitioner.
