KARACHI: Sindh High Court (SHC) has sought comments from the standing counsel on a constitution petition filed by M/s Cargo King against show cause and demand notices issued by customs authorities.
A two-member bench, comprising Justice Munib Akhter and Justice Anwar Hussain was hearing the constitution petition.
Earlier petitioner’s counsel stated that petitioner’s company is engaged in the business of customs clearing agent and forwarding business. It imported consignment of 17 branded vehicles including Nissan, Suzuki, Daihatsu and being a clearing agent filed goods declaration accordance with the law of duties.
According to the petitioner, after releasing of the said vehicles, impugned demand notices were issued to the said importers due to inadvertence shot levied amount on the said vehicles on account of excess depreciation claimed in terms of CGO 14/2005 dated 06/06/2005 as amended vide CGO 01/2009 dated January 1, 2013. In term of said demand notice, the officials of the respondents has also threatened to adopt coercive action by initiating harsh proceedings against the petitioner without providing any lawful basis and without providing any hearing opportunity.
Citing Customs Appraisement-West assistant collector and collector as respondents, the petitioner pleaded the SHC may declare that impugned demand notice is illegal, malafide, unjustified and restrain them from taking any coercive action against the petitioner.
